(details of which are listed in the Annex to these Terms), Claire's Accessories UK Ltd, a private company registered in England and Wales under company number 3115118, with its registered office at Unit 4 Bromford Gate, Bromford Lane, Birmingham, B24 8DL and VAT number 927124727 (for residents of the United Kingdom), Claire's Accessories UK Ltd, Irish Branch, a branch of Claire’s Accessories UK, Ltd. registered in Ireland under registration number 904461 with a registered address at Claire’s Store at The Outlet Centre Fair Hill, Unit 28, Killarney, Co Kerry, ROI (for residents of Ireland), and Claire’s France S.A.S., a company organized and existing under the laws of France under company number RCS 342 837 416, with an office at 10 Avenue Kléber, 75116 Paris, France (for residents of France) (“we”, “us” or “our”). Please read these Terms carefully before you consent to receiving these text messages from us.

We may send you text messages using an automatic telephone dialing system, to the mobile telephone number you provided when signing up or any other number that you designate.

You agree that you are the age of majority where you reside are legally resident in that country and are using a local mobile number to subscribe. If you are under the age of majority but at least 16 years of age, you may participate in our text messaging program only under the supervision of a parent or legal guardian who agrees to be bound by these Terms. If you are a parent or legal guardian agreeing to these Terms on behalf of a child between the ages of 16 and the age of majority, you acknowledge and agree that you are fully responsible for the child’s participation in our text messaging program, including any legal liability the child may incur.

Consent to receive automated marketing text messages is not a condition of any purchase.

Your mobile network operator may charge you to send and receive SMS and MMS messages. Please see your mobile network operator’s message & data rates for more information. These charges are paid by you to the mobile network operator (or another third party) and not to us.

Message frequency will vary. We reserve the right to alter the frequency of messages sent at any time, so as to increase or decrease the total number of sent messages. We also reserve the right to change the short code or phone number from which messages are sent and we will notify you when we do so.

Not all mobile devices or handsets may be supported and our messages may not be deliverable in all areas or to all mobile network operators or mobile virtual network operators. In order to provide promotional and personalised marketing texts, we will process personal data about you. Please read our Privacy Policy as it explains how we use and protect your personal data.

Cancellation

Text the keyword STOP to our shortcode to opt out of receiving our text messages. After texting STOP to our shortcode you will receive one additional message confirming that your request has been processed. You acknowledge that our text message platform may not recognize and respond to unsubscribe requests that do not include the STOP keyword command. If you unsubscribe from one of our text message programs, you may continue to receive text messages from us through any other programs you have joined until you separately unsubscribe from those programs.

Governing law and dispute resolution

These terms (including non-contractual disputes or claims) are governed by English law. If you are a consumer resident in an EU member state, and we direct the text messaging program to (and/or pursue our commercial or professional activities in relation to our text message program in) the country in which you are resident, you will benefit from any mandatory provisions of the law of the country in which you are resident. Nothing in these terms and conditions affects your rights as a consumer to rely on such mandatory provisions of local law.

You may bring any dispute which may arise under these terms to, at your discretion, either the competent court of England, or to the competent court of your country of habitual residence if this country of habitual residence is within the UK or is an EU Member State, which courts are (with the exclusion of any other court) competent to settle any of such a dispute. We shall bring any dispute which may arise under these terms to the competent court of your country of habitual residence if this is within the UK or is an EU Member State or otherwise the competent court of England.
