Official Rules

NO PURCHASE OR PAYMENT IS NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING. THIS PRIZE DRAW IS OPERATED BY CLAIRE’S ACCESSORIES UK LIMITED OF UNIT 4, BROMFORD GATE, BROMFORD LANE, BIRMINGHAM, B4 8DW UNITED KINGDOM (“CLAIRE’S”).

1. Eligibility

   Claire's Earrings 4 Life Competition (the “Prize Draw”) is open to residents of Great Britain, Republic of Ireland, France, Netherlands, Switzerland, Spain, Germany and Portugal, aged 13 or over at the date on which they enter the promotion (provided that written parental or legal guardian consent must be obtained in advance by users under the age of 18 in order to enter the Prize Draw). Proof of residency and age may be required. Employees and directors of Claire’s and its subsidiaries, divisions, affiliates, and advertising or promotional agencies or individuals involved with the design, production, execution or distribution of the Prize Draw and the immediate family and household members of such individuals, are not eligible to enter or win. “Immediate family members” shall mean parents, stepparents, children, stepchildren, siblings, stepsiblings, or spouses, regardless of where they live. “Household members” shall mean people who share the same residence at least three months a year, whether related or not. By entering the Prize Draw, all participants must accept these Official Rules in full. All entry instructions form part of these Official Rules.

2. Timing

   Entry to the Prize Draw opens on December 26, 2019 at 12:01 a.m. GMT and closes on December 25, 2020 at 11:59 p.m. GMT (“Entry Period”). No entries received after the closing time will be eligible to win a prize.

3. How to Enter

   There are two (2) ways to enter the Prize Draw:

   • Purchasing Ear Piercing or Purchasing an Ear Piercing Lotion. During the Entry Period, get your ears pierced or purchase any sized bottle of ear piercing lotion at a participating Claire’s store and provide your email address to a Claire’s store Sales Associate, to be entered into the Prize Draw. Entrants aged under 18 must have a parent or legal guardian sign a permission form and show photo identification before getting ears pierced.

   • Enter by Email. To enter without a purchase, send a blank email to: [email protected] with the subject: Claire’s Earrings 4 Life Sweepstakes Entry.

   • Limit one (1) entry per email address. Email entries must be received by December 25, 2020 by 11:59pm GMT. Sponsor is not responsible for lost, late, incomplete, invalid, unintelligible, illegible or misdirected email entries.

   Limit one (1) entry per person regardless of method of entry. You are not permitted to share the same email address with another entrant. Any attempt by any entrant to submit more than one entry by any method will lead to disqualification from the Prize Draw. Use of any automated system to enter is prohibited and will result in disqualification. Claire’s is not responsible for lost, late, incomplete, invalid, unintelligible or misdirected entries all of which will be ineligible to enter the Prize Draw. In the event of a dispute as to any entrant, the authorized account holder of the email address used to enter will be deemed to be the entrant. The “authorized account holder” is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. Potential winners of any prize may be required to show proof of being the authorized account holder to be awarded the prize.

4. Winner Determination

   On or about January 5, 2021, Claire’s will select one (1) entrant for each prize at random by computer from all eligible entries. Odds of winning depend on the number of eligible entries received during the Prize Draw Entry Period. Potential winners will be notified by email and will be required to respond by the deadline stated in their notification to accept their prize, such response to include (where required by Claire’s in the potential winner notification email) written confirmation of their eligibility to receive the prize. In the event that Claire's is unable to contact a potential winner by the deadline stated in their notification to accept their prize, Claire's reserves the right to award the prize to an alternative entrant selected at random. Limit of one prize per person. Prizes will be delivered to an address provided by the winner within 30 working days from a valid acceptance of the prize. Claire’s' decisions as to the administration and operation of the Prize Draw and the selection of the potential winner is final and binding in all matters related to the Prize Draw (without prejudice to the available legal remedies set forth in section 9 below).

5. Verification of Potential Winners

   In the event that a potential winner: (a) cannot be reached for whatever reason by the deadline stated in their notification and after a reasonable effort has been exerted or the potential winner notification is returned as undeliverable; (b) declines or cannot accept, receive or use the prize for any reason; (c) is found to be ineligible to enter the Prize Draw or receive the prize, or (d) cannot or does not comply with these Official Rules, the potential winner shall be disqualified from the Prize Draw and an alternate potential winner may be selected, at random, from among the other eligible entries received.

6. Prizes

   There are a total number of eleven (11) prizes to be won:

   One (1) grand prize will be awarded. The grand prize winner will receive one (1) pair of 14 carat diamond earrings (14 carat yellow or white gold 5pt diamond .1 ct tw), 600 pairs of earrings and a £25, €27.65, or CHF31.36 Claire’s Gift Card. Approximate retail value of the grand prize is £3350, €3704, or CHF4201, as of December 2019.

   Ten (10) runner-up prizes will be awarded. Each runner-up prize winner will receive a £25, €27.65 or CHF31.36 Claire’s Gift Card. Approximate retail value of all runner-up prizes is £250, €276 or CHF314, as of December 2019.

   Gift Card Terms: Gift Cards are redeemable for merchandise only at Claire’s retail stores in the UK and Europe and, in respect of the UK only, online at http://www.claires.com. Gift Cards are subject to Claire’s’ terms and conditions and may not be returned, redeemed for cash (except to the extent required by law) or used as payment on or credit to any credit card accounts. Not valid on prior purchases. The Gift Card will not be replaced if lost or stolen. In the event the winner purchases more than the stated value worth of merchandise, the winner will be solely responsible for payment of those costs

   For the Grand Prize: There is no cash equivalent and the prize is non-transferable and no substitution will be made, except as provided herein at Claire’s’ sole discretion. Claire’s reserves the right to substitute the listed prize for one of equal or greater value for any reason. Approximate Retail Value of the Grand Prize is £3350 or €3704 euros or CHF4201, as of December 2019.

7. Publicity

   Each winner will, where they have consented in advance, participate in reasonable publicity as may be required by Claire’s in respect of the Prize Draw. Where a winner consents to doing so, Claire’s may publish each winner's name, photograph and country of residence on its website and social media profiles or to publicise the prize-giving presentation within a year of the closing date.

8. General Conditions

   Claire's reserves the right to extend, withdraw, alter or suspend the Prize Draw or these Official Rules at any time if circumstances beyond its control make this unavoidable, in which case affected entrants may withdraw from the Prize Draw.

   Save as set out below in respect of entrants who are residents of Germany (as applicable), if Claire’s fails to comply with these Official Rules, Claire’s is responsible for loss or damage you suffer that is a foreseeable result of Claire's’ breach of these Official Rules or its negligence, but it is not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if they were an obvious consequence of Claire's’ breach or if they were contemplated by you and Claire's at the time that you entered this Prize Draw.

   In respect of entrants who are residents of Germany only, Claire’s statutory liability for damages shall be limited as follows:

   Claire’s shall be liable only up to the amount of damages as typically foreseeable at the time of entering into the contract in respect of damages caused by a slightly negligent breach of a material contractual obligation (“Kardinalpflicht”, i.e. a contractual duty the fulfilment of which is essential for the proper execution of the contract, the breach of which endangers the purpose of the contract and on the fulfilment of which the entrant regularly relies);

   Claire’s shall not be liable for damages caused by a slightly negligent breach of a non-material contractual obligation;

   the aforesaid limitation of liability shall not apply to any mandatory statutory liability (in particular to liability under the German Product Liability Act), liability for assuming a specific guarantee or liability for damages caused by willful misconduct or gross negligence, or any kind of willfully or negligently caused personal injuries; and

   to the extent Claire's' liability is limited or excluded, the same shall apply in respect of any personal liability of Claire’s' legal representatives, employees and vicarious agents.

9. Disputes

   The Prize Draw and these Official Rules, and any dispute or claim arising out of or in connection with them, are governed by English law. You can bring proceedings in respect of these Official Rules and the Prize Draw in the English courts. However: (a) if you live in another European Union member state you can bring legal proceedings in respect of these Official Rules and the Prize Draw in either the English courts or the courts of that member state; and (b) if you live in Switzerland you can bring legal proceedings in respect of these Official Rules and the Prize Draw in either the English courts or the courts of Zurich, Switzerland.

   If you are entering this Prize Draw from a European Union member state, you will benefit from any mandatory provisions of the law of the country in which you are resident and nothing in these Official Rules, including the preceding paragraph, affects your rights as a consumer to rely on such mandatory provisions of local law.

10. Entrant’s Personal Information

    All personal data submitted in connection with the Prize Draw will be processed by Claire’s for the purposes of administering and managing the Prize Draw and prizes (where applicable) and verifying the eligibility of each participant. Claire's is committed to protecting the privacy of all participants. Data that is collected from or about participants will be used in accordance with Claire’s Privacy Policy, which is available at https://www.claires.com/privacy-policy.html?lang=en_GB.

11. Prize Draw Results

    Prize winners’ surnames or first names and surname initial, counties/regions and countries of residence will be made available on request unless a prize winner objects to this. To request Prize Draw results, send an email with the subject line of “Winners List – Claire’s Earrings 4 Life Competition” to [email protected]. To object to your surname or first name and surname initial, county/region and country being made available in this manner in the event you are a prize winner please let us know by sending an email to [email protected]. Please note that in any event your surname or first name and surname initial, county/region and country may be passed to relevant regulatory bodies if Claire's is required to do so. Requests for the winner’s list must be received by March 1, 2021.
