Claire’s Rewards Terms and Conditions
PLEASE READ THESE TERMS AND CONDITIONS (“TERMS”) CAREFULLY. BY ACCESSING OR PARTICIPATING IN THE CLAIRE’S REWARDS PROGRAM, YOU AGREE TO BE BOUND BY THESE TERMS AND ALL TERMS INCORPORATED HEREIN BY REFERENCE. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT ACCESS OR PARTICIPATE IN THE CLAIRE’S REWARDS PROGRAM.
These Terms include an arbitration provision that governs any disputes between you and Claire’s. This provision will affect your rights, including preventing you from bringing, joining or participating in class or consolidated proceedings and will also eliminate your right to a trial by jury.
These Terms apply to your access to, and participation in, the Claire’s Rewards program in the United States (“Claire’s Rewards”), which is operated by Claire’s Stores, Inc. or its respective subsidiaries (collectively, “Claire’s”, “us”, or “we”). Any changes to these Terms will be effective immediately upon posting the revisions to www.claires.com/us/rewards. Your continued access to, or participation in, Claire’s Rewards following any such changes confirms your acceptance of these Terms and such changes. You should review these Terms, related policies, and FAQs related to Claire’s Rewards to fully understand the terms and conditions that apply to your access to and participation in this program.
Joining Claire’s Rewards & Eligibility
Claire’s Rewards is open to legal residents of the United States who are 13 years of age or older. A valid email address is required to create a Claire’s Rewards Account (“Rewards Account”). A Rewards Account is required to be eligible for Claire’s Rewards. Limit one Rewards Account per person. No purchase or fee is required to enroll.
Claire’s Rewards is a customer rewards program that allows members to earn and accumulate points (“Points”) that can be redeemed for coupons (“Reward Coupons”). Reward Coupons and other offers associated with Claire’s Rewards may be governed by additional terms, such as specific expiration dates, purchase limitations, item restrictions, redemption locations, or legal disclosures (“Additional Terms”). Please review any applicable Additional Terms, which are hereby incorporated into to these Terms.
You may create a Rewards Account to join Claire’s Rewards by:
(1) visiting www.claires.com/us/rewards (“Rewards Site”) and following the prompts to create a Rewards Account;
(2) visiting any Claire’s retail store in the United States and asking a store associate to help you sign up;
(3) downloading the Claire’s mobile application (“Claire’s App”) which is available to download from the Apple App Store or Google Play Store on most devices and following the prompts to create a Rewards Account; or
(4) by any other methods offered by Claire’s.
When you enroll in Claire’s Rewards and create a Rewards Account, you are agreeing to receive email messages related to Claire’s Rewards and additional general marketing emails from Claire’s. Those who have opted out of receiving marketing emails from Claire’s will still be able to participate in Claire’s Rewards and receive informational messages about their Rewards Account.
If you believe a Rewards Account may have been created in error, please contact Customer Service at firstname.lastname@example.org or 1-888-CLAIRES (1-888-252-4737) to review your options. Claire’s may, in its sole discretion, allow individuals to combine or consolidate existing Rewards Accounts, subject to and in accordance with these Terms.
Points may be earned when you: (1) make a qualifying purchase at a Claire’s retail store in the United States; (2) make a qualifying purchase at a Claire’s Walmart store in the United States; (3) make a qualifying purchase on www.claires.com or through the Claire’s App (each a “Qualifying Purchase”); or (4) participate in other opportunities offered by Claire’s (“Additional Qualifying Activities”) (collectively, “Qualifying Activities”).
Additional Qualifying Activities may include, but are not limited to, a one-time reward of a certain number of Points per person for completing your Rewards Account profile, visiting Claire’s social media profiles (e.g., Instagram, Facebook), signing up for text messages, signing up for email newsletters, downloading the Claire’s App, or signing up for Claire’s App push notifications. These one-time rewards of a certain number of Points per person cannot be earned more than once for one Rewards Account and cannot be applied to more than one Rewards Account. Additional Terms may apply to Additional Qualifying Activities.
- You must have a valid Rewards Account to earn Points through Qualifying Activities. Points cannot be accrued for purchases made before enrollment in Claire’s Rewards.
- To earn Points for a Qualifying Purchase at a Claire’s retail store, you must provide the store associate with your email address (or mobile phone number, if provided during the enrollment process) when prompted during the sales transaction.
- To earn Points for a Qualifying Purchase on www.claires.com, you must log into your www.claires.com account, which is connected to your Rewards Account, before making a purchase.
- Points cannot be accrued for: any purchase made using a Reward Coupon, store credit, or merchandise credit; charity donations; purchase of a gift card; redemption of a gift card; or any purchase that comes with a gift (gifts-with-purchase).
- Points will not be awarded for processing charges, delivery surcharges, shipping and handling, taxes, state and any other applicable governmental fees, charges for plastic shopping bags, and purchases not linked to your Rewards Account.
- Points are calculated after discounts are deducted from or coupons are applied to the purchase price.
- You cannot earn Points for any unauthorized or fraudulent charges. Claire’s reserves the right to remove Points earned from any unauthorized or fraudulent charges from your Rewards Account.
Points for purchases made through www.claires.com or the Claire’s App qualify once all items have shipped and will be automatically added to your Rewards Account within approximately 36 hours of shipment. Points for purchases of items in the same transaction that are shipped separately will be added to your Rewards Account once the final item has shipped. For in-store purchases and Additional Qualifying Activities, Points will appear in your Rewards Account within approximately 36 hours of your completion of the Qualifying Activity. You may view your activity in the Rewards Account status emails we send to you, by logging into your Rewards Account at www.claires.com/us/rewards, on the Claire’s App, or by contacting Customer Service at email@example.com or 1-888-CLAIRES (1-888-252-4737).
Value of Points
Points do not have any monetary or cash value and are not redeemable for cash. You will receive 1 Point for every $1.00 spent with your Rewards Account. For every 100 Points you earn, you will receive a $5.00 Reward Coupon. The value of Points earned may change from time to time, at Claire’s sole discretion, in accordance with these Terms. Points are calculated based on the purchase price of the item(s) at the time of purchase, after discounts and coupons have been applied, and before taxes and fees are applied. Qualifying Purchases will be rounded down to the nearest whole dollar amount before being calculated as Points if the Points calculation is less than .5 (e.g., a Qualifying Purchase of $5.49 will earn 5 Points) and Qualifying Purchases will be rounded up to the nearest whole dollar amount before being calculated as Points if the Points calculation is equal to or greater than .5 (e.g., a Qualifying Purchase of $5.50 will earn 6 Points).
Once you accumulate the required number of Points to earn a Reward Coupon, those Points will be deducted from your Rewards Account and converted to a Reward Coupon. Reward Coupon(s) will be issued to your Rewards Account on the fourth business day of the month after the month during which the required number of Points has accumulated in your Rewards Account, and will be sent to the email address associated with your Rewards Account. Issued Reward Coupons can be accessed by logging into the Rewards Site or the Claire’s App and viewing your Claire’s Rewards profile, by identifying yourself as a Claire’s Rewards member by providing the email (or mobile phone number, if provided during the enrollment process) associated with your Rewards Account in-store, or by contacting Customer Service at www.claires.com/us/rewards or 1-888-CLAIRES (1-888-252-4737). Reward Coupons will be issued in $5.00 increments with unique promo codes that can be used in-store or online (“Reward Coupon Code”). Each Reward Coupon Code may be used only once. Points will be converted to Reward Coupons in the order that the Points were earned. Claire’s may change the manner in which Points are calculated, how many Points must be accrued to earn a Reward Coupon, and the value of a Reward Coupon at any time, in accordance with these Terms.
Point Expiration and Reward Coupon Expiration
Points accrued in your Rewards Account will expire 12 months from the date of the Qualifying Activity. Each Reward Coupon will expire 90 days after it is issued.
Reward Coupon Redemption
You may only use Reward Coupons that are associated with your own active Rewards Account. Unexpired Reward Coupons may be redeemed when making purchases of Claire’s merchandise at any Claire’s retail store or Claire’s Walmart store in the United States, or by entering the Reward Coupon Code when making a purchase on www.claires.com or the Claire’s App.
Reward Coupons may not be redeemed for purchases of Claire’s merchandise made at any other retailer (e.g., CVS, Hy-Vee, Jewel, WinCo, or Giant Eagle).
Reward Coupons cannot be applied to previous purchases, charity donations, purchase of a gift card or redemption of a gift card, processing charges, delivery surcharges, shipping and handling, charges for plastic shopping bags, taxes, or state and any other applicable governmental fees. The value of Reward Coupons is calculated in United States dollars.
Only one (1) Reward Coupon may be redeemed per purchase on www.claires.com or the Claire’s App. Multiple Reward Coupons may be redeemed when making a purchase at a Claire’s retail store in the United States. A minimum merchandise purchase of $5.01 (excluding taxes and shipping charges) is required in order to redeem your Reward Coupons on www.claires.com or via the Claire's App.
Any remaining unused amount of a redeemed Reward Coupon will be forfeited (and no cash back or change will be given for the unused amount). When using a Reward Coupon, you are responsible for all charges in excess of the value of the Reward Coupon. Claire’s store associates may reject the use of any Reward Coupons that may violate these Terms or otherwise be fraudulent.
The Reward Coupon will be applied after all other promotional credits or discounts offered at the time of purchase are applied to your purchase.
To use a Reward Coupon when making a purchase in one of our retail stores in the United States you must identify yourself as a Claire’s Rewards member by providing the email address (or mobile phone number, if provided during the enrollment process) associated with your Rewards Account at checkout. Claire’s reserves the right to require the person using a Reward Coupon to show proof that they are the person associated with the corresponding Rewards Account.
To use a Reward Coupon when making a purchase on www.claires.com, you must log into your online account associated with your Rewards Account and enter the Reward Coupon Code in the “coupon code” box at checkout. Claire’s reserves the right to require the person using a Reward Coupon to validate that they are the person associated with the corresponding Rewards Account.
You are solely responsible for all federal, state, and local taxes and any other costs or expenses of accepting and using Reward Coupons or other promotional credits or discounts offered at the time of purchase.
You shall not give, sell, or otherwise provide Reward Coupon Codes, Reward Coupons, or Points to any other person. You shall not copy, imitate, or otherwise fabricate Reward Coupon Codes, Reward Coupons, or Points, nor shall you give, sell, or otherwise provide such copies, imitations, or fabrications to any other person.
Other Claire’s Rewards Benefits
By creating and maintaining a Rewards Account, you are eligible to receive:
1. A one-time 20% discount automatically applied to your next purchase following enrollment in Claire’s Rewards. This benefit is valid at www.claires.com, the Claire’s App U.S., Claire’s retail stores and Claire’s Walmart stores only, and may not be applied to purchases of Claire’s merchandise made at any other retailer. The discount will not be applied to taxes, shipping and handling, charity donations, prior purchases, or charges for plastic shopping bags. This benefit does not expire, but once redeemed cannot be reapplied to any future purchases.
2. An annual special birthday offer associated with the Rewards Account, if you provide a date of birth. You will receive an email detailing the offer, which is subject to Additional Terms.
3. Free shipping twice per year on online purchases through www.claires.com. Shipping offers apply to standard shipping and handling in the forty-eight (48) contiguous United States. This benefit is only valid on items that are in stock. You will be provided with a unique promo code twice per year. Additional Terms may apply to the eligibility of items for this benefit.
4. Exclusive promotional offers as determined in Claire’s sole discretion from time-to-time and subject to Additional Terms.
5. Advance notice of product launches and special events.
6. Invitations to participate in special Points events, subject to Additional terms.
If you return a purchase for which you earned Points (in accordance with Claire’s then- current return policy), the Points associated with your Rewards Account will be reduced by the number of Points equivalent to the amount of the earned Points you originally received. In the event of an even exchange, any Points earned in association with the original purchase will remain in your Rewards Account. In the event of an exchange of an item of lesser value, the difference in value from your original purchase will be deducted from your Rewards Account in the form of appropriately-calculated Points. In the event of an exchange for an item of greater value, any additional expenditure will accrue Points in accordance with these Terms. Any new promotional offers in effect at the time of an exchange will not apply, nor modify your Rewards Account balance.
If you return an item purchased using a Reward Coupon, the refund will exclude the Reward Coupon amount. You may contact Customer Service at firstname.lastname@example.org or 1-888-CLAIRES (1-888-252-4737) to have your Reward Coupon reinstated.
Points, Reward Coupons, and Rewards Accounts Are Non-Transferable and Not Redeemable for Cash
Except where required by applicable law, Rewards Accounts, Points, Reward Coupons, and other Claire’s Benefits and do not have any monetary or cash value and they may not be redeemed for cash and do not have any cash equivalent except when being used to make purchases of Claire’s merchandise subject to these Terms. Rewards Accounts, Points, and Reward Coupons are not transferable to any other person.
If the total amount of a purchase you make using a Reward Coupon is less than the amount of the Reward Coupon, you will forfeit the balance of the Reward Coupon. For example, if you use a $5.00 Reward Coupon to make a $4.50 purchase, you will not be given $.50 in change, nor will Points be credited back to your Rewards Account.
Termination or Closure of Your Rewards Account
Claire’s is not responsible for Points or Reward Coupons that expire, are lost, or are redeemed due to fraudulent activity. Suspected illegal, fraudulent, or other unauthorized use or misuse of Points, Reward Coupons, or any other activity inconsistent with these Terms may, in the sole and absolute discretion of Claire’s, result in termination or revocation of your participation in Claire’s Rewards. Such termination will result in the loss of all accumulated Points earned and Reward Coupons issued but not yet redeemed.
You may elect to close your Rewards Account at any time by calling Claire’s at 1-888-CLAIRES (1-888-252 4737) or emailing Claire’s at email@example.com. Upon any closure or termination of your Rewards Account, any Points associated with your Rewards Account will automatically drop to zero. If you later elect to re-enroll in Claire’s Rewards, you will have access to any unexpired Reward Coupons associated with your terminated Rewards Account, however, your beginning Points balance will be zero (with the exception of any welcome Points added to your new Rewards Account, if applicable).
Updating Your Rewards Account
You may access and update your Rewards Account information, including your email address by logging into your online account on www.claires.com or on the Claire’s App, at any U.S. Claire’s retail store, by emailing our Customer Service Team at firstname.lastname@example.org, or by calling us at 1-888-CLAIRES (1-888-252-4737). It is your responsibility to keep your member information current, complete, and accurate. You are solely responsible for any and all activities that occur under your Rewards Account. Individuals who access their Rewards Account through www.claires.com or the Claire’s App are responsible for maintaining the confidentiality of their login credentials and for restricting access to their computer or mobile device that may result in unauthorized or fraudulent activity on their Rewards Account.
Modification of Claire’s Rewards
Claire’s reserves the right to modify, suspend, terminate, or otherwise change any aspect of Claire’s Rewards, these Terms, and Additional Terms, including without limitation, the eligibility conditions for participation in Claire’s Rewards, the manner in which you participate, the manner and rates at which Points and Reward Coupons are earned and redeemed, redemption mechanisms, or what constitutes an Qualifying Activity, with reasonable notice to you of any material changes. Changes to these Terms will be reflected by the “Effective Date” listed at the top of these Terms. We will post changes to www.claires.com/us/rewards and may notify you of material changes by email to the email address then associated with your Rewards Account.
Dispute Resolution, Binding Arbitration, and Waiver of Jury Trial
If a dispute arises between you and Claire’s, you and Claire’s agree, as permitted by applicable law, to resolve any claim or controversy at law or equity arising out of, relating to, or connected in any way with Claire’s Rewards through binding arbitration or as we and you otherwise agree in writing. Before resorting to these alternatives, we strongly encourage you to first contact us directly at www.claires.com to seek a resolution. We will consider reasonable requests to resolve the dispute through alternative dispute resolution procedures, such as mediation or arbitration, as alternatives to litigation.
Certain portions of this section are deemed to be a “written agreement to arbitrate” pursuant to the Federal Arbitration Act. You and Claire’s agree that we intend that this section satisfies the “writing” requirement of the Federal Arbitration Act. This section can only be amended by mutual agreement.
If any controversy, allegation, or claim relates in any way to your use of Claire’s Rewards (collectively, “Dispute”), then you agree the Dispute shall be submitted to confidential arbitration in Illinois except that we may seek injunctive or other appropriate relief in any state or federal court. You hereby consent to, and waive, all defenses of lack of personal jurisdiction and forum non conveniens with respect to venue and jurisdiction in the state and federal courts of Illinois. Arbitration under these Terms shall be conducted pursuant to the Commercial Arbitration Rules then prevailing at the American Arbitration Association; any dispute shall otherwise be governed by the internal laws of the State of Illinois without regard to Illinois choice of law principles, except that the provisions of this agreement concerning arbitration shall be governed by the Federal Arbitration Act. The arbitrability of disputes shall be determined by the arbitrator. The arbitrator’s award shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
If for any reason a claim proceeds to court rather than arbitration, you and Claire’s agree to waive any right to a jury trial.
These Terms and any Additional Terms compliment and incorporate by reference the Claire’s online privacy policies and general terms and conditions found on www.claires.com and on the Claire’s App.
Claire’s Rewards is enforceable as permitted by applicable law. If any part of these Terms or Additional Terms is invalid or unenforceable under applicable law, the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision, and the remainder of these Terms and Additional Terms will govern such participation. Our performance under these Terms and Additional Terms will be excused to the extent that such performance is hindered, delayed or made commercially impractical by causes beyond our reasonable control.
These Terms and Additional Terms constitute the entire agreement between you and Claire’s with respect to Claire’s Rewards. These Terms supersede all prior or contemporaneous communications and proposals, whether electronic, oral or written, between you and Claire’s with respect to this Claire’s Rewards.
Participation constitutes your full and unconditional agreement to these terms and Claire’s decisions, which are final and binding in all matters related to these Terms and the Rewards Program and which Claire’s may decide in its sole discretion.
